1. Introduction and Acceptance of Terms

Welcome to Facts A Day! These Terms of Service ("Terms") govern your use of the Facts A Day mobile application ("App"), operated by Yusuf Seyrek ("we," "us," "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1.1 Eligibility

The App is available to users of all ages. If you are under 18 years old (or the age of majority in your jurisdiction), you represent that you have obtained permission from your parent or legal guardian to use the App.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

Download and install the App on your personal mobile device
Use the App for your personal, non-commercial use
Access the App's features and content

This license is granted for personal use only and may not be shared, sold, or transferred to any third party.

2.2 License Restrictions

You agree NOT to:

Reverse engineer, decompile, or disassemble the App or attempt to derive the source code
Modify, adapt, translate, or create derivative works based on the App
Remove, obscure, or alter any copyright, trademark, or other proprietary notices
Rent, lease, lend, sell, redistribute, or sublicense the App
Use the App for any commercial purpose without our prior written consent

2.3 Platform-Specific Terms

Your use of the App is also subject to the terms and conditions of the platform from which you downloaded it:

In case of conflict between these Terms and platform terms, the platform terms shall prevail for platform-related matters.

The App and all content, features, and functionality (including but not limited to text, graphics, logos, icons, images, and software) are owned by Yusuf Seyrek and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

3. User Conduct and Prohibited Uses

You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for your use of the App.

3.2 Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

Violating any applicable local, state, national, or international law or regulation
Infringing upon or violating our intellectual property rights or the rights of others
Harassing, abusing, threatening, or harming others
Transmitting any viruses, malware, or other malicious code
Attempting to bypass, disable, or interfere with security-related features

Engaging in any activity that could damage, disable, overburden, or impair the App or our servers
Using the App to spam, phish, or engage in any fraudulent activity
Collecting or harvesting any personally identifiable information from the App
Using the App in any manner that could interfere with other users' enjoyment of the App

We reserve the right to:

Investigate violations of these Terms
Take appropriate legal action against anyone who violates these Terms
Remove or refuse access to content that violates these Terms
Terminate or suspend your access to the App at our sole discretion

Facts provided in the App are curated from various sources. While we strive for accuracy, we make no guarantees about the completeness, reliability, or accuracy of the content. Some facts may include attribution to original sources when available.

4.4 Restrictions on Content Use

You may not:

Copy, reproduce, distribute, or publicly display facts or content from the App
Use content for commercial purposes without permission
Create derivative works based on App content
Remove or modify any copyright notices or attributions

Permitted Use: You may share individual facts through the App's built-in sharing features (if available) for personal, non-commercial purposes.

4.5 Feedback

If you provide us with feedback, suggestions, or ideas about the App ("Feedback"), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use, modify, and incorporate such Feedback into the App without compensation or attribution to you.

Ad Blockers: Using ad blockers or attempting to circumvent ads may violate these Terms and result in degraded App functionality.

The availability, accuracy, or content of external sites
Privacy practices of external sites
Your interactions with external sites

Your use of external websites is at your own risk and subject to their terms and policies.

5.4 No Endorsement

Inclusion of third-party services, ads, or links does not constitute an endorsement, sponsorship, or recommendation by us.

6. Disclaimers

FACTS ARE FOR ENTERTAINMENT AND EDUCATIONAL PURPOSES ONLY. Do not rely on facts from the App for making important decisions, medical advice, legal advice, or professional guidance.

6.3 No Warranties

We do not warrant that:

The App will meet your requirements or expectations
The App will be available at all times or without interruptions
Any errors or defects will be corrected
The App is free from viruses or other harmful components
Your use of the App will be secure or error-free

6.4 Device Compatibility

We do not guarantee compatibility with all devices, operating systems, or configurations. The App's performance may vary based on your device and network connection.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED:

This reflects the fact that the App is provided free of charge.

7.3 Basis of the Bargain

The limitations in this section reflect an allocation of risk and are a fundamental element of the basis of the bargain between you and us. The App would not be provided without these limitations.

8. Termination

8.1 Termination by You

You may stop using the App at any time by:

Uninstalling the App from your device
Deleting the App and all associated data

This will terminate your license to use the App.

8.2 Termination by Us

We reserve the right to:

Suspend or terminate your access to the App at any time, with or without cause, with or without notice
Refuse service to anyone for any reason at any time

Grounds for termination may include (but are not limited to):

Violation of these Terms
Abusive or harmful behavior
Fraudulent or illegal activity
Inactivity for an extended period
Technical or security concerns

8.3 Effect of Termination

Upon termination:

Your license to use the App immediately ceases
You must delete the App from all your devices
All disclaimers, limitations of liability, and dispute resolution provisions survive termination

Termination does not affect any rights or obligations that accrued before termination.

8.4 No Refunds

Since the App is free, no refunds are applicable. If you made any in-app purchases (if applicable in the future), refunds will be subject to the app store's refund policy.

9. Dispute Resolution and Governing Law

9.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

For users outside Turkey, local consumer protection laws may also apply.

9.2 Jurisdiction

You agree that any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Turkey, unless your local law requires otherwise.

9.3 Informal Resolution

Before filing any formal legal action, you agree to first contact us at seyrek91@gmail.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve disputes amicably.

9.4 Arbitration (Optional)

If we cannot resolve a dispute informally, either party may elect to resolve the dispute through binding arbitration in accordance with the rules of an agreed-upon arbitration body. This provision is optional and does not waive your rights under local law.

9.5 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.

9.6 Time Limit for Claims

You agree that any claim or cause of action arising out of these Terms or the App must be filed within one (1) year after the claim or cause of action arose. Otherwise, such claim or cause of action is permanently barred.

10. Notifications and Communications

10.1 Daily Notifications

The App provides daily fact notifications at your chosen time. By using the App, you consent to receive:

Daily fact notifications (local notifications, not push notifications)
Occasional important service announcements (rare)

10.2 Opting Out

You can disable notifications at any time through:

The App's settings

Disabling notifications may reduce the App's usefulness but does not affect other functionality.

10.3 Service Communications

We may send you communications related to:

Changes to these Terms or the Privacy Policy
Technical issues or updates
Security alerts

These are not promotional and cannot be opted out of (except by uninstalling the App).

10.4 Electronic Communications

By using the App, you consent to receive communications from us electronically. All agreements, notices, and disclosures that we provide electronically satisfy any legal requirement that such communications be in writing.

11. Miscellaneous Provisions

11.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements, understandings, or representations.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to:

War, terrorism, civil unrest, or government actions
Internet outages, cyberattacks, or infrastructure failures
Pandemics, epidemics, or public health emergencies

11.6 Relationship of the Parties

Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us. You have no authority to bind us or make commitments on our behalf.

11.7 Third-Party Beneficiaries

These Terms are for the benefit of you and us only. No third party has any right to enforce or benefit from these Terms, except as explicitly stated (e.g., platform providers like Apple or Google for their respective terms).

11.8 Language

These Terms are provided in English. If translated into other languages, the English version shall prevail in case of any conflict or inconsistency.

11.9 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

11.10 Survival

Provisions that by their nature should survive termination shall survive, including but not limited to: intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution.

12. Platform-Specific Terms

12.1 Apple App Store Users

If you downloaded the App from the Apple App Store, the following additional terms apply:

License: The license granted to you is limited to a non-transferable license to use the App on an iOS device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
Maintenance and Support: Yusuf Seyrek (not Apple) is solely responsible for providing maintenance and support for the App, as specified in these Terms or as required by applicable law.
Warranty: To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. Any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to any warranty will be our sole responsibility.
Product Claims: Yusuf Seyrek (not Apple) is responsible for addressing any claims relating to the App, including: (a) product liability claims; (b) claims that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
Intellectual Property Claims: In the event of any third-party claim that the App infringes that third party's intellectual property rights, Yusuf Seyrek (not Apple) is solely responsible for investigation, defense, settlement, and discharge of such claim.
Third-Party Beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
Legal Compliance: You represent and warrant that: (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

12.2 Google Play Store Users

If you downloaded the App from Google Play, the following additional terms apply:

Google's Role: Google is not responsible for the App or its content. Google has no obligation to provide maintenance or support for the App.
Warranty: Any claims related to the App are directed to Yusuf Seyrek, not Google.
Google Play Terms: Your use of the App is also subject to the then-current Google Play Terms of Service.

13. Updates and Modifications

13.1 App Updates

We may release updates, upgrades, or new versions of the App from time to time. Updates may:

You are encouraged to install updates promptly to ensure optimal performance and security.

13.2 Automatic Updates
